Wild Sol Creatives
1. General Terms
1.1 These Terms and Conditions apply to all services provided by Wild Sol Creatives, a photography business based in the Netherlands, operating worldwide.
1.2 By booking a session with Wild Sol Creatives, the client agrees to these Terms and Conditions.
1.3 Wild Sol Creatives reserves the right to decline any project that does not align with its expertise or values.
2. Booking and Payment
2.1 Weddings
A non-refundable deposit of 20% of the total package fee is required to secure your wedding date.
The remaining balance is due within 7 days of delivering the final images.
2.2 Other Sessions
A signed contract and a non-refundable deposit of 20% of the total fee are required to secure your booking.
The remaining balance is due within 7 days of delivering the final images.
2.3 Retreats
A signed contract and a non-refundable deposit of 20% of the total fee are required to secure your booking.
Full payment must be made prior to departure for retreat branding shoots.
All travel expenses and accommodation for retreats must be covered by the host.
Additional costs incurred during the retreat (e.g., unforeseen travel, extra meals) will be invoiced separately.
2.4 Payment Methods
All payments must be made via bank transfer.
3. Cancellation and Rescheduling Policy
3.1 Cancellation by the Client
Cancellations made more than 30 days before the session result in the loss of the deposit but no additional fees.
Cancellations made between 15-29 days before the session will incur a fee of 50% of the total session cost.
Cancellations made less than 14 days before the session will require full payment of the agreed-upon fee.
3.2 Retreat Cancellations
The deposit is non-refundable, regardless of cancellation timing.
Cancellations made less than 45 days before the retreat will require full payment of the agreed-upon fee.
In the event of a retreat being canceled by the host, the client is responsible for reimbursing any non-refundable travel or accommodation expenses already incurred by Wild Sol Creatives.
3.3 Rescheduling
Rescheduling is permitted once without penalty if requested at least 14 days before the session, subject to availability.
Additional rescheduling requests will incur a 20% fee of the total package cost.
3.4 Cancellation by Wild Sol Creatives
In the unlikely event that Wild Sol Creatives needs to cancel a session or retreat due to unforeseen circumstances, all fees and deposits will be fully refunded.
Alternatively, the client may choose to reschedule the session or retreat at no additional cost.
4. Travel and Accommodation
4.1 General Travel
For shoots outside of the Netherlands, travel and accommodation costs will be invoiced separately unless otherwise agreed.
Mileage within the Netherlands is charged at €0.23 per kilometer from Den Haag.
4.2 Retreats
All travel expenses and accommodation for retreats are the responsibility of the host and must be covered in full.
Flights, transportation to and from the retreat location, and accommodations should be arranged and communicated to Wild Sol Creatives at least 30 days prior to the retreat start date.
5. Image Delivery and Storage
5.1 Edited high-resolution images will be delivered via an online gallery within [4-6 weeks] after the session or retreat.
5.2 RAW files are not included in any package.
5.3 The client is responsible for downloading and backing up the images within 60 days of delivery.
5.4 Wild Sol Creatives will store the images for a period of 2 years from the date of the shoot. After this period, the images may be permanently deleted from storage systems.
6. Usage Rights and Copyright
6.1 All images remain the copyright of Wild Sol Creatives.
6.2 The client receives a non-exclusive, non-transferable license to use the images for personal or business purposes, including social media and website usage, with credit to the photographer.
6.3 Clients are required to tag @lindsmccallb or @wildsolcreatives when sharing images on social media excluding wedding clients.
6.4 Commercial usage (e.g., advertising campaigns) requires prior written agreement and may incur additional fees.
6.5 The photographer retains the right to use images for portfolio, website, and marketing purposes unless explicitly stated otherwise by the client in writing.
7. Client Responsibilities
7.1 The client agrees to provide a detailed brief or inspiration for the session or retreat, especially for branding and adventure shoots.
7.2 For weddings, family sessions, and retreats, the client is responsible for coordinating schedules and ensuring all participants are present at the agreed time and location.
7.3 Any additional shooting time due to delays or rescheduling will incur extra charges.
8. Limitation of Liability
8.1 Wild Sol Creatives is not liable for any failure to perform due to circumstances beyond its control, including but not limited to natural disasters, strikes, or illness.
8.2 In the unlikely event of total photographic failure, liability is limited to a refund of all payments received.
9. Privacy
9.1 Client information will be kept confidential and only used for communication and project management purposes.
9.2 Wild Sol Creatives will not share or sell client data to third parties.
10. Dispute Resolution
10.1 Any disputes arising from these Terms and Conditions shall be resolved under Dutch law, with exclusive jurisdiction in the courts of Den Haag Netherlands.
